1. Agreement to Terms

By accessing or using Data Owl, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access our services. Data Owl provides a conversational analytics platform for ecommerce businesses.

2. Description of Service

Data Owl offers an analytics layer that connects with third-party ecommerce platforms like Shopify and WooCommerce. Our service generates narrative reports and insights based on your store's data.

• You must authorize our application to securely connect to your ecommerce platform.
• We pull and normalize data such as orders, products, and customer behavior to calculate metrics like LTV, repurchase rates, and churn risk.
• Data Owl provides recommendations, but any business actions taken based on our insights are solely at your own risk.

3. User Accounts

To use Data Owl, you must register for an account (authenticated via WorkOS). You are responsible for safeguarding your login credentials and for any activities or actions under your account.

• You must provide accurate and complete information upon registration.
• You are responsible for managing access permissions for team members within your organization.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use

You agree not to use Data Owl in any way that is unlawful, illegal, fraudulent, or harmful. Specifically, you agree not to:

• Use the service to store or transmit malicious code, viruses, or malware.
• Attempt to gain unauthorized access to our systems or disrupt the integrity or performance of the platform.
• Connect ecommerce stores to Data Owl that you do not own or do not have explicit permission to analyze.
• Exceed fair usage limits or utilize the service in a way that places an unreasonable load on our infrastructure.

5. Intellectual Property

Your Data: You retain all rights, ownership, and interest in your ecommerce store data. We claim no ownership over the raw data you import from platforms like Shopify or WooCommerce. Our use of your data is strictly limited to providing the service, as outlined in our Privacy Policy.

Our Platform: Data Owl and its original content, features, analytics models, reporting interfaces, and functionality are and will remain the exclusive property of Data Owl and its licensors. The service is protected by copyright, trademark, and other laws.

6. Limitation of Liability

In no event shall Data Owl, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service.
• Any conduct or content of any third party on the service.
• Any business or marketing decisions you make based on the insights provided by our platform.
• Unauthorized access, use, or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or request account deletion.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
